Juvenile delinquency has been a talking point since a few years. It refers to a crime committed by a minor or an underage person. Juvenile Justice Act, 1986 and 2000 prescribed, a juvenile as a person who has not attained the age of 16yrs in case of a boy and 18yrs in case of a girl should be tried by juvenile courts as a minor. But the debate and the hue and cry generated after the gang rape in 2012 led to the amendment of the act.

Delhi Gang rape changed the perception towards Juvenile Act leading to a new version of the law in the form of Juvenile Justice (Care and Protection of Children) Act, 2015. This act prescribed, a juvenile as a person who has not attained the age of 16yrs in case of a boy and 18yrs in case of a girl should be tried by juvenile courts as an adult in case of heinous crimes. The juvenile justice board has been given a power to decide whether a juvenile is to be treated as an adult basis the nature of the crime or should the person be sent to care center. 

Heinous crime means a crime involving an imprisonment of 7 or more years as decided under the act keeping in mind the terms mentioned in the Indian Penal Code. The categories of crime do not limit itself to rape and murder but it includes crimes like theft, cheating, kidnapping, dacoity, grievous hurt, counterfeiting, arson and burglary.

The type of crime and the intensity with which it was being committed in some of the recent events led to the amendment in the existing law and it also led to the realization of criminal activity traits in a person. When a minor involved in one of the heinous crimes, his background, family, environment, etc. is questioned.

The crimes being committed by juveniles are increasing and each person of the society needs to think on how to curb these activities. Some of the major reasons behind the commission of the crimes are:

a)      Need of money: Teenagers today are on a lookout for latest technologies, gadgets, fashion, and assignment help etc. being influenced seeing the people around. When they are unable to purchase one with the help of their parents, they think of some immoral activity in order to buy them. This can include a theft or borrowing money from friends. The parents need to note down when his/her child builds this intention so that it can be curbed with a proper explanation.

b)      Environment at home and in neighborhood: If a child has a parent quarrelling on petty issues then this can lead the child being disrespectful to others. Gamblers on the side of street, drunken people, etch may also lead the child to think that they can also join them leading to criminal activities. Parents and guardians should be involved with their children and should always teach them the importance of leading a disciplined life.

c)       Competition: When the teenagers are compared with their peers to perform well it leads the child to think that his/her parent is a villain in their life so parents should abstain from comparisons. They can sit with their children and provide assignment help them in their studies.

d)      Wrongful company: A student may be going in one of the best schools but he is more influenced with the type of people surrounding him more than the teaching being imparted. Parents should ensure to visit their school and enquire about their friends in order to check on the company being kept by their children.

When a child gets involved in any of the immoral or criminal activity, his/her activity should not be avoided or hided rather they should be explained its gravity. If the parents are unable to explain them then they should take them to counseling center.

After the 2012 rape case more criminal cases involving minors came up. There were was an incident in Dec, 2017, where a minor killed his mother and sister as they were after him for studies. In 2018 a minor was involved in killing his principal. In Sept, 2018, an eight year old was killed by one of his seniors so that the exams can be postponed.

Juvenile delinquency is one of the national issues being faced by our country and every now and then different crimes are being committed by minors leading the country as well as the parents to think and question the validity of the Act.

Although the Juvenile Justice (Care and Protection of Children) Act, 2015 has given a right to treat a minor as an adult when committing a heinous crime but the punishment remains the same. A juvenile is given a three years of punishment on the establishment of such crime as compared to adults committing the same crime getting seven years or more for the same crime.

The act believes in reformation but habitual offenders and the gravity with which such acts are being committed by a juvenile cannot lead to reformation and what about the justice to the victimized person. Is the punishment sufficient to provide justice to the victim? No, the quantum of punishment is too less.

Everyone needs to come along and help in eradicating such crimes. Different reformation centers at small towns and cities should be established when the reach of educationally backward regions. Counseling centers providing free services should be established at backward areas and parents should be informed about the importance of such centers so that they can take their children along with them. The juvenile’s should not be casted away from the society rather they should be realized the importance of each and every activity and to respect each and every person. A stricter punishment needs to be provided to a regular offender or a person committing a serious crime without being remorseful so that it can deter others from committing same crime. Each and every activity of a minor should be monitored in order to curb Juvenile delinquency.
